These Terms of Use ("Terms") govern your access to and use of EXPLR — our websites, applications, content, courses, and EXPLR Edge® credentialing programs (the "Services"), operated by EXPLR PBC Inc. ("EXPLR," "we," "us," or "our").

By creating a free account or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1.Who Can Use EXPLR

• You must be 13 or older to use EXPLR.
• If you are between 13 and 17, you may use the free Services; depending on where you live, a parent or guardian may need to provide consent (see our Privacy Policy).
• You are responsible for the activity on your account and for keeping your login credentials secure.
• You agree to provide accurate information and to keep it up to date.

2.Free Accounts and Paid Edge® Programs

EXPLR is free to use. Some EXPLR Edge® programs carry a fee.

• You must be 18 or older to purchase a paid Edge® program. If the learner is under 18, an adult aged 18 or older must make the purchase and hold the financial contract.
• Fees, billing terms, and any cancellation or refund terms are described at the time of purchase and in our Cancellation Policy.
• Payments are handled by our payment provider. We do not store full payment card details.

3.EXPLR Edge® Credentials

EXPLR Edge® credentials are issued and verified through Credly. An Edge® credential is real proof of the learning it represents; it is not an accredited qualification, and that boundary is intentional.

4.Acceptable Use

When using the Services, you agree not to:

• use the Services for any unlawful purpose or to infringe the rights of others;
• copy, redistribute, or publicly display our video content or other materials outside the Services;
• disrupt, overload, scrape, or attempt to gain unauthorized access to the Services;
• share your account or misrepresent your identity or eligibility.

5.Our Content and Intellectual Property

Unless otherwise noted, the materials on our websites and in our Services are owned by or licensed to EXPLR and are protected by intellectual-property laws. You may access, download, or print materials for personal, non-commercial, or educational use only. You may not reproduce, distribute, modify, or republish our materials without our written consent.

6.Your Work

You keep full ownership of the work you create. When you submit portfolio materials for an EXPLR Edge® program, we use them only to assess your work and issue your credential. We do not claim ownership of your work, and we do not sell, license, or reuse it for any other purpose.

We keep a record of the credential you earn so it stays verifiable, but we do not retain your project work beyond what is needed to assess and issue it. We will only feature your work or likeness publicly (for example, in marketing or on social media) where we have your permission — and a parent or guardian's permission where required. We handle personal information as described in our Privacy Policy.

7.Third-Party Content

Some courses include free educational videos hosted on platforms such as YouTube. Your use of that content is also subject to the hosting platform's terms. See our Third-Party Content Notice for details on what your fee does and does not cover.

8.Accuracy and No Warranties

Our content is offered for informational and educational purposes. We do not warrant that content is error-free or complete, and we encourage you to independently verify material. The Services are provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law.

9.Limitation of Liability

To the fullest extent permitted by law, EXPLR and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from or related to your use of the Services.

10.Suspension and Termination

We may suspend or terminate access to the Services, or to any account, if these Terms are violated or to protect the Services or other users. You may stop using the Services at any time.

11.Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Where required by law, we will provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12.Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection law applies to you.
